1. Scope and Application

This Policy governs the collection, calculation, and exemption of Sales and Use Tax applicable to transactions processed by Xpress Supply LLC through www.xsupplystore.com and affiliated sales channels.

Xpress Supply LLC is registered with the Texas Comptroller of Public Accounts and complies with the provisions of the Texas Tax Code – Title 2, Subtitle E (Sales, Excise, and Use Taxes).


2. Application of State Sales Tax

a) Sales Within Texas

  • All sales shipped to addresses within the State of Texas are subject to state and local Sales Tax, currently averaging 8.25%, unless the customer provides a valid tax exemption certificate.
  • Sales Tax is automatically calculated during checkout based on the shipping or delivery location.

b) Sales Outside Texas

  • Xpress Supply LLC does not ship outside the State of Texas.
  • In the event of future interstate operations, applicable Wayfair Sales Tax Nexus (2018) rules and destination-state tax collection requirements will apply.

3. Sales Tax Calculation

Sales Tax is calculated based on the total order amount, including:

  • Product costs
  • Handling or packaging fees (if applicable)
  • Shipping and delivery charges (when required by law)

Sales Tax does not apply to non-taxable services (such as diagnostic or consulting fees), unless otherwise required by Texas law.


4. Tax-Exempt Status

Customers who qualify for tax exemption must provide a valid exemption certificate issued by the Texas Comptroller of Public Accounts prior to purchase.

Accepted Documents

  • Texas Sales and Use Tax Exemption Certificate (Form 01-339)
  • Texas Resale Certificate (Form 01-339 Section 1)
  • Texas Agricultural Exemption Certificate (Form 01-924), when applicable
  • Official religious, educational, or governmental exemption letters issued by the Comptroller

Procedure

1️⃣ Submit the completed and signed form to support@xsupplystore.com before completing the purchase.

2️⃣ Xpress will review and validate the documentation.

3️⃣ Once approved, the customer will receive written confirmation of tax-exempt status and may complete purchases without Sales Tax.

Important: If the exemption documentation is not submitted before payment is processed, Sales Tax will be automatically applied and cannot be removed retroactively.


5. Renewal and Validity

Exemption certificates remain valid as long as:

  • The customer continues operating under the same declared purpose (resale, exempt activity, etc.)
  • Tax information and business address remain current
  • The exemption status has not been revoked by the Comptroller

Xpress may request annual or periodic updates of exemption certificates to maintain active exempt status records.


6. Customer Responsibility

Customers are responsible for:

  • Providing accurate and current tax information
  • Using the exemption solely for purposes authorized by the Comptroller (such as resale or institutional use)
  • Retaining supporting documentation for at least four (4) years for audit purposes

Improper use of a tax exemption may constitute a violation of Texas Tax Code §151.707 and may result in administrative or criminal penalties and fines.


7. Tax Refund Requests

  • Customers with valid tax-exempt status who paid Sales Tax in error may request a review within 30 days of purchase by providing their exemption certificate and invoice number.
  • Xpress will verify eligibility and, if approved, process a refund or issue store credit.
  • After this period, refund claims must be submitted directly to the Texas Comptroller of Public Accounts.

8. Recordkeeping and Document Retention

Xpress maintains digital and physical records of all transactions, exemptions, and submitted certificates in compliance with Texas Comptroller Rules §3.281–3.286 for a minimum period of four (4) years.


9. Additional Local Taxes

Additional local taxes may apply in certain municipal or county jurisdictions.

Tax calculations are automatically updated based on the customer’s address using the Texas Comptroller’s Sales Tax Rate Locator database.


10. Limitation of Liability

  • Xpress Supply LLC operates in strict compliance with applicable tax laws and does not provide personalized accounting or tax advice.
  • Customers should consult their accountant, CPA, or tax advisor to determine exemption eligibility.
  • Xpress shall not be liable for errors, omissions, penalties, or sanctions resulting from inaccurate information or improper use of tax exemption certificates submitted by the customer.

11. Governing Law

This Policy shall be governed by the laws of the State of Texas, including the Texas Tax Code, the Texas Administrative Code (Title 34, Part 1, Chapter 3), and IRS Publication 510 provisions related to excise taxes.

Any dispute shall be resolved before the competent courts of Bexar County, Texas.
