Xpress Supply LLC markets HVAC equipment and supplies (heating, ventilation, and air conditioning) to customers across the 48 contiguous United States. We do not currently ship to Alaska, Hawaii, Puerto Rico, or international destinations.

Product availability, specifications, pricing, and images may change without prior notice. We reserve the right to modify or discontinue products, adjust pricing, or update inventory at any time.

All prices are listed in U.S. Dollars (USD) and do not include applicable taxes, shipping, or installation costs unless expressly stated otherwise.

5. Purchases and Payments

By placing an order, the User represents and warrants that:

• They are at least 18 years old.
• They have the legal capacity to enter into binding agreements.
• They provide accurate and up-to-date information.

Payments may be made by credit card, debit card, bank transfer, or financing through affiliated entities. Xpress does not store payment card information on its servers; payment processing is handled by secure PCI DSS-certified platforms.

All transactions are subject to verification and approval. Orders may only be cancelled in cases of pricing errors, suspected fraud, inventory unavailability, or legal compliance requirements. Customers will be notified promptly and refunded in full when applicable.

6. Shipping and Deliveries

Shipping services are available throughout the 48 contiguous United States. Shipping costs, transit times, and carrier availability vary by product, weight, and delivery address.

Shipping terms, delivery times, and costs are governed by the Shipping Policy available on the Site. Xpress shall not be held liable for delays caused by carriers, weather conditions, or circumstances beyond the Company's control.

7. Returns, Refunds, and Exchanges

Return and refund procedures are detailed in the Returns and Refunds Policy. All requests must comply with the applicable eligibility requirements and deadlines. Xpress reserves the right to reject returns that do not meet these conditions.

8. Taxes and Exemptions

Xpress Supply LLC collects sales tax in states where it has a legal obligation to do so under applicable federal and state law. The tax amount applied to your order is calculated based on the type of product, the delivery address, and Xpress Supply's nexus obligations in the state where the order is delivered. Tax is always displayed at checkout before payment is submitted.

Customers claiming tax-exempt status must contact Xpress Supply by phone before placing their order and provide valid documentation for the state where the order will be delivered. Exemptions cannot be applied after an order has been placed. Please refer to the Sales Tax & Exemption Policy for full details.

9. Financing and Deferred Payments

Available financing plans are administered by independent financial institutions. Xpress Supply LLC does not provide direct credit and does not guarantee financing approval. The customer acknowledges that all financing terms, rates, and conditions are determined solely by the approving financial institution.

10. Intellectual Property

All Site content, including text, logos, images, designs, icons, graphics, software, and data, is the property of Xpress Supply LLC or its suppliers and is protected under United States copyright laws and international treaties. Any reproduction, distribution, or copying, in whole or in part, without prior written authorization is strictly prohibited.

11. Limitation of Liability

Xpress shall not be liable for indirect, incidental, or consequential damages arising from the use of, or inability to use, the Site. This includes, without limitation, loss of data, revenue, or profits, even if advised of the possibility of such damages.

The use of online tools, including calculators, guides, or estimators, is provided for informational purposes only and does not replace professional technical evaluation.

12. Governing Law

These Terms shall be governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any dispute shall be resolved before the courts of competent jurisdiction located in Harris County, Texas, or in the federal courts serving the Southern District of Texas, Houston Division.
