Xpress Supply LLC offers customers access to several payment, installment-payment, financing, and lease-to-own options through independent third-party providers. This policy explains the role of Xpress Supply LLC, the responsibilities of each provider, and the terms customers should review before submitting an application or accepting an agreement.

1. Scope of This Policy

This policy applies to purchases made through xpressacsupply.com and other authorized Xpress Supply LLC sales channels.

Available payment options may include major credit and debit cards, ACH direct debit, approved electronic payments, installment-payment programs, financing products, and lease-to-own arrangements.

Provider availability may vary based on the equipment selected, purchase amount, customer location, eligibility requirements, applicable law, and each provider's current programs.

2. Role of Xpress Supply LLC

Xpress Supply LLC is an independent HVAC equipment retailer. Xpress Supply LLC is not a bank, credit bureau, lender, financing company, lessor, financial adviser, or account-servicing company.

Xpress Supply LLC may provide access to independent providers, but it does not:

• Approve or deny financing, installment-payment, or lease-to-own applications;
• Establish underwriting or eligibility requirements;
• Set interest rates, annual percentage rates, finance charges, lease costs, or provider fees;
• Determine down payments, recurring payment amounts, or payment due dates;
• Determine whether a credit inquiry, identity verification, or credit reporting will occur;
• Guarantee approval, prequalification, purchasing power, or a specific payment plan;
• Modify, extend, cancel, refinance, or renegotiate a provider agreement;
• Service financing or lease accounts or collect scheduled provider payments;
• Explain the specific reason for an approval or denial decision; or
• Control how a provider processes information submitted through its application.

Any financing, installment-payment, or lease-to-own agreement is entered into directly between the customer and the selected provider or its applicable lending or banking partner. The provider's transaction-specific agreement and disclosures control that relationship.

Customers should contact Xpress Supply LLC before applying if they need help selecting compatible equipment, confirming system components, understanding product specifications, checking inventory, or locating payment options during checkout.

Xpress Supply LLC can provide product-selection and checkout guidance. Xpress representatives cannot provide legal, tax, credit, or financial advice; select a provider for a customer; compare the customer's personal financial suitability; or promise approval.

5. Applications, Eligibility and Customer Information

When a customer selects a third-party option, the customer may be redirected to or shown an application operated by the selected provider.

The provider may request personal, identity, financial, banking, employment, credit, device, fraud-prevention, or transaction information according to its policies and applicable law.

Information entered directly into a provider's application is collected and processed by that provider and, where applicable, its lending, banking, verification, servicing, or technology partners.

Xpress Supply LLC may receive information reasonably necessary to process the retail order, including contact information, shipping information, order details, payment-authorization status, transaction identifiers, approval confirmation, cancellation, dispute, delivery,
return, or refund status.

Information received directly by Xpress Supply LLC is handled according to the Xpress Supply Privacy Policy.

6. Rates, Fees, Lease Costs and Payment Terms

Xpress Supply LLC does not promise or guarantee any interest rate, annual percentage rate, finance charge, lease cost, approval amount, credit limit, down payment, recurring payment, payment schedule, promotional period, early-purchase amount, or ownership cost.

Any payment estimate, promotional offer, purchasing-power estimate, or lease-payment example displayed before the provider presents its final agreement is informational only.

The provider's final transaction-specific agreement and disclosures control. Customers should review the total amount financed or leased, payment frequency, applicable rates or charges, provider fees, automatic-payment terms, cancellation procedures, credit-reporting terms,
early-purchase options, and ownership requirements before accepting.

7. No Installation Services

Xpress Supply LLC sells HVAC equipment and does not provide, sell, finance, arrange, schedule, supervise, or perform installation services.

No installation labor, permit, inspection, site preparation, electrical work, plumbing work,
ductwork modification, refrigerant service, equipment startup, testing, removal, disposal, or related contractor service is included in the equipment price unless expressly identified in a separate written offer issued by Xpress Supply LLC.

Xpress Supply LLC does not employ, appoint, dispatch, recommend, certify, endorse, control, or supervise HVAC installers or contractors. Any installer selected by a customer is an independent third party and is not an employee, agent, representative, partner, or subcontractor
of Xpress Supply LLC.

The customer is solely responsible for independently selecting a properly qualified and, where required, licensed and insured installer. The customer must verify the installer's qualifications, licenses, insurance, permits, experience, pricing, scope of work, and compliance with applicable building, electrical, mechanical, environmental, and safety requirements.

Any agreement for installation or related services is a separate agreement between the customer and the installer. Xpress Supply LLC is not a party to that agreement and does not receive, collect, finance, administer, or guarantee payments for installation services.

8. Installation, Handling and Equipment Responsibility

To the extent permitted by applicable law, Xpress Supply LLC is not responsible for acts, omissions, representations, charges, delays, workmanship, negligence, code violations, permit issues, injuries, property damage, system performance, or disputes involving an independent installer, contractor, technician, freight handler, or other third party.

Xpress Supply LLC is not responsible for damage, malfunction, reduced performance, incompatibility, refrigerant loss, electrical failure, water damage, property damage, personal injury, or other loss caused by:

• Improper transportation, storage, lifting, handling, or relocation after delivery;
• Incorrect equipment sizing or selection made without complete property information;
• Improper installation, wiring, ductwork, drainage, charging, startup, testing, or maintenance;
• Failure to follow manufacturer instructions, technical specifications, or safety warnings;
• Installation by an unqualified or unlicensed person where licensing is required;
• Unauthorized alteration, modification, repair, disassembly, or replacement of components;
• Use of incompatible accessories, controls, refrigerants, electrical components, or system parts;
• Failure to obtain required permits or inspections;
• Site conditions, structural conditions, electrical capacity, drainage, ventilation, or environmental conditions; or
• Normal wear, misuse, abuse, neglect, accident, improper maintenance, or external events.

Improper installation, handling, alteration, or use may affect manufacturer-warranty coverage.
Warranty eligibility and exclusions are determined by the applicable manufacturer and warranty
terms, subject to rights that cannot legally be waived.

This section does not exclude responsibility for Xpress Supply LLC's own acts or obligations
when liability cannot lawfully be disclaimed.

9. Installation Disputes and Provider Payments

A dispute involving an installer, contractor, installation charge, permit, inspection, workmanship, equipment handling, system startup, or property damage does not automatically cancel the customer's retail purchase or suspend, reduce, or terminate obligations under a separate financing, installment, or lease-to-own agreement.

Customers must continue following the selected provider's agreement unless the provider confirms a change in writing or applicable law provides otherwise. Xpress Supply LLC cannot direct a provider to suspend payments, waive charges, cancel an agreement, change an account balance, or approve a financing or lease dispute.

Installation charges paid directly to an independent installer are not part of the amount paid to Xpress Supply LLC and are not refundable by Xpress Supply LLC.

Customers must direct installation-related complaints and refund requests to the installer who performed or agreed to perform the work. Questions involving a financing, installment-payment, or lease account must be directed to the applicable provider.

Nothing in this policy waives any claim, defense, refund right, warranty right, or other consumer protection that cannot be waived under applicable federal or state law or under the customer's provider agreement.

10. Order Confirmation and Product Responsibility

Provider approval does not guarantee product availability or acceptance of an order by Xpress Supply LLC.

An order is complete only after Xpress Supply LLC receives valid payment or provider authorization, verifies the order information, confirms product availability, and issues an order confirmation.

Xpress Supply LLC is responsible only for the equipment, quantities, specifications, services, and commitments expressly identified in the applicable product listing, order confirmation, and Xpress Supply LLC policies, subject to applicable law.

Xpress Supply LLC may reasonably review, hold, reject, or cancel an order to address suspected fraud, payment problems, pricing or listing errors, inventory limitations, shipping restrictions, incomplete information, or other circumstances permitted by its policies and applicable law.

11. Delivery Inspection and Freight Damage

Customers must inspect shipments according to the Xpress Supply LLC
Shipping Policy. Visible freight damage, missing items, incorrect items, or packaging damage should be documented and reported within the time and manner required by that policy.

Damage occurring after delivery because of storage, relocation, lifting, unpacking, installation, alteration, or handling by the customer, installer, or another third party is not freight damage caused by Xpress Supply LLC.

12. Cancellations, Returns and Refunds

Product cancellations, returns, and refunds are governed by the Xpress Supply LLC
Return & Refund Policy. The selected provider's separate procedures may also apply to the customer's account.

Submitting a cancellation, return, installation complaint, warranty claim, or payment dispute does not automatically cancel or modify an agreement with a financing, installment-payment, or lease-to-own provider.

When Xpress Supply LLC approves a refund, Xpress will submit the applicable amount through the original payment method or provider. Provider processing and account-adjustment times may vary.

Customers must continue complying with their provider agreement until the provider confirms that a refund, cancellation, or account adjustment has been completed, except where applicable law provides otherwise.

Questions about merchandise, shipment, order cancellation, return eligibility, or the refund amount authorized by Xpress should be directed to Xpress Supply LLC. Questions about account balances, payment schedules, interest, lease payments, early-purchase amounts, provider fees, credit reporting, or account status must be directed to the applicable provider.

13. Manufacturer Warranties

Manufacturer warranties, when available, are provided by the equipment manufacturer and are subject to the manufacturer's registration requirements, exclusions, procedures, and warranty terms.

Xpress Supply LLC does not expand, replace, or independently guarantee a manufacturer's warranty unless Xpress expressly provides a separate written warranty.

Installation labor, diagnostic services, removal, reinstallation, refrigerant, shipping, travel, permits, and other contractor charges are not covered by Xpress Supply LLC unless expressly stated in a written Xpress policy or agreement.

Warranty questions should be reviewed under the Xpress Supply LLC
Warranty Policy and the applicable manufacturer's warranty documentation.

14. Privacy and Electronic Communications

Each third-party provider maintains its own privacy policy describing how it collects, uses, shares, retains, and protects personal information. Customers should review that policy before submitting an application.

Xpress Supply LLC does not control a provider's independent privacy, underwriting, identity-verification, fraud-prevention, servicing, or credit-reporting practices.

Xpress Supply LLC handles information it receives directly according to its
Privacy Policy.

Provider applications and agreements may be delivered electronically. Customers may be required to consent to electronic records, signatures, text messages, emails, automatic payments, or other communications. Those consents are governed by the provider's agreement and privacy policy.

15. Applicable Consumer Protections

Third-party financing, installment-payment, and lease-purchase transactions may be subject to applicable federal and state consumer-protection, lending, leasing, privacy, electronic-signature, credit-reporting, advertising, and unfair-or-deceptive-practices laws.

Depending on the transaction, these requirements may include the Truth in Lending Act, Regulation Z, the Consumer Leasing Act, Regulation M, the E-SIGN Act, the Fair Credit Reporting Act, the Federal Trade Commission Holder Rule, and applicable state financing or lease-purchase laws.

Not every law applies to every provider or transaction. The selected provider is responsible for presenting the disclosures and agreement applicable to its product. Customers should retain copies of all agreements, disclosures, payment schedules, receipts, and confirmations.

Nothing in this policy limits or waives any legal right or remedy that cannot lawfully be limited or waived.

16. Governing Agreements

The agreement and disclosures presented by the selected provider govern the financing, installment, or lease-to-own service.

The Xpress Supply LLC Terms and Conditions, Privacy Policy, Shipping Policy, Return & Refund Policy, Warranty Policy, and applicable product listing govern Xpress Supply's retail sale and handling of the order.

If this policy conflicts with a transaction-specific provider agreement, the provider agreement controls the customer's relationship with that provider. Xpress Supply's applicable policies continue to control Xpress's sale, fulfillment, shipment, return, and refund obligations.

17. Policy Updates

Payment providers, financing programs, lease-to-own programs, contact information, terms, and availability may change without notice.

Customers should consult each provider's current website and review the disclosures presented during the transaction. Xpress Supply LLC may update this policy when its payment options, store policies, or business practices change.

Contact Xpress Supply LLC before applying if you need help selecting compatible equipment, confirming what is included in an order, or locating available payment options.

After submitting an application, questions concerning approval, denial, interest, fees, financing terms, lease costs, recurring payments, ownership, early-purchase options, account servicing, credit reporting, or information submitted to a provider must be directed to that provider.
